Massachusetts Couple Lose Foster License After Declining to Sign Gender-Affirming Policy

Massachusetts Department of Children and Families has stripped a couple of their foster license after years of caring for vulnerable kids because they refused to sign a form forcing them to “affirm” a child’s gender identity and use their “preferred pronouns.”

This country needs better foster parents, and the State of Massachusetts is no exception. That’s why it’s not only bizarre but deeply unserious that DCF has decided to revoke the foster license of one caring couple. Whether or not this has something to do with their Christian faith, well… you will have to do the math.
A married couple from Woburn, Massachusetts, had their foster care license revoked after declining to sign a gender-affirming policy agreement required by the state’s Department of Children and Families (DCF).
Lydia and Heath Marvin, parents of three teenagers, have cared for eight foster children under four since 2020. Their latest foster child, an infant with significant medical challenges, lived with them for 15 months. However, under the guise of inclusivity, the state has decided that foster kids will be better off without them.
According to CBS:
"Our Christian faith, it really drives us toward that. James says that true undefiled religion is to care for the fatherless," said Heath.
The couple said they were prepared to care for more foster children until DCF pulled their license to foster in April.
That's because the Marvins refused to sign the agency's LGBTQIA+ Non-Discrimination Policy because of their Christian faith. Starting in 2022, the policy said that foster families must affirm the LGBTQIA+ identity of foster children.
So, by the state essentially pretending not to discriminate against “LGBTQIA+” individuals, two good people have lost their license, despite the lifelong positive impact they could potentially have on children. Something doesn’t add up here. And unfortunately, in the progressive pursuit of affirming identities, everyone ends up worse off, especially the very children the state claims to be helping.
Since DCF has existed, this policy has never been in place—meaning it’s entirely unnecessary. If I didn’t know any better, I might call it a violation of the couple’s constitutional rights—but I do know better, so I won’t say that. Still, others have already raised that issue, which is why the state is now being sued for attempting to force Americans to violate their religious convictions to affirm falsehoods. As it turns out, likely, the government doesn’t have the authority to do that.
"We asked, is there any sort of accommodation, can you waive this at all? We will absolutely love and support and care for any child in our home but we simply can't agree to go against our Christian faith in this area. And, were ultimately told you must sign the form as is or you will be delicensed," Lydia said.
The Marvins appealed the loss of their license, but lost. They're considering their options but two other Christian foster families are plaintiffs in a federal lawsuit filed by the Massachusetts Family Institute and Alliance Defending Freedom against DCF.
Again, I’m no legal expert, but I would be almost certain that, in the end, the Christian foster family will regain their license—though we’ll have to wait and see. Nonetheless, while CPS pretends to be fully committed to helping children, this does nothing of the sort. Instead, it harms them, as the state prioritizes appearing inclusive over providing meaningful care. To say that this will never be justified is an understatement.
