I forget who suggested using the "who masturbated on Zoom" as a qualifier whenever referencing Jeffrey Toobin. It may have been Matt Walsh. Whoever it was, I agree and am doing my part. Especially when Toobin, CNN's chief legal content creator, says dumb things like this: Donald Trump "changing the makeup of the court" totally makes our Constitution a political document.

"If the only thing that matters is Republicans appointing justices to the Supreme Court, if that's the only thing that changes what the Constitution means, then the Constitution is entirely a political document."

At issue isDobbs v. Jackson Women's Health Organization, a legal challenge to Mississippi's ban on abortion after 15 weeks. It is currently before the Supreme Court. There is concern/hope this case could finally overturn Roe vs. Wade. And judging by tweets and breathless headlines, it might very well happen this week, hence, Toobin's silly claim bout the Constitution.

Donald Trump managed to name three conservative justices, so the court now leans conservative 6-3. As opposed to all the other decades when it leaned left. Toobin never got chirpy over that. But because DONALD TRUMPITY TRUMP was allowed to do what every other president did, it makes our Constitution a political document. Because the 6-3 majority can, in Toobin's words, "change what the constitution means," it makes the Constitution a political document.

Not when Bill Clinton or Barack Obama appoint justices. Not if the rumors of Joe Biden nominating Kamala Harris to the bench just to get rid of her are true. When it's justices that Toobin agrees with politically "changing what the constitution means" as they've been doing for decades, that's fine. It's only a bad thing when it's justices who you and I agree with politically.

Toobin and CNN think normal people can't see through this.
