While one may argue that the government was never intended to be the arbiter of truth, you don't need elected officials to determine biological reality. This used to be called “common sense.” And common sense would tell you that changing your gender on documents based on ambiguous and abstract feelings is not rooted in truth. This is why the government has a civic duty to bar gender confused individuals from changing government documents like their birth certificates and ID cards. Montana's highest court, however, believes otherwise and has found that the state has violated its constitution by barring trans people from living in their imagination.

According to Courthouse News:

Montana cannot block transgender residents from changing their government-issued identification documents to align with their gender identity, according to the state Supreme Court.

“Transgender discrimination is, by its very nature, sex discrimination,” Montana Supreme Court Justice Laurie McKinnon wrote on behalf of the majority. “Discrimination based on sex is expressly prohibited under Montana’s unique nondiscrimination clause.”

The problem with this claim is that, according to the left, sex and gender are two different things. Subsequently, trans discrimination cannot be sex discrimination, considering we are talking about something different. And considering the very premise of transgression is to deny one's sex, this majority opinion is illogical, at best.

Enacted in 2023 by the Montana Legislature, Senate Bill 458 defined “sex” as binary and based on the biological and genetic indications present at birth. Shortly after it went into effect, the Department of Health and Human Services announced it would stop amending birth certificates based on “gender transition, gender identity or change of gender.”

In 2024, two transgender Montanans sued the state, arguing the policies violate the state Constitution. Specifically, the plaintiffs requested that they be able to amend the sex designation on their birth certificate and driver’s license as permitted under the state’s previous policy.

At the end of the year, a lower court issued a preliminary injunction blocking the state from enforcing the policies. The court found that cisgender and transgender residents are equivalent in all relevant respects other than their status as transgender or cisgender, but only cisgender Montanans can amend their birth certificates or driver’s licenses to accurately reflect their gender identity, which violates the constitutional right to be free from discrimination on the basis of sex.

What a load of nonsense, and one of these things is not like the other. Changing your birth certificate to reflect some imaginary identity has no basis in reality. Courts shouldn't even take these claims seriously, but here we are, in 2026, where adults are playing imagination all the way to some of the highest courts in the land. This is deeply deranged.

It is not compassionate to lie to trans people and allow them to play pretend by changing their birth certificate. Not only is this not rooted in reality, but it has no place in legal theory. The fact that the courts actually upheld such a nonsensical opinion proves just how lost society has become. And this will never put them on the right side of history.
