So, it turns out that the government has no right to decide whether or not your kid identifies with the LGBT rainbow. Who would have thought?
SCOTUS has overturned Colorado's conversion therapy ban, which includes talk therapy for trans-identified children, under the guise that it violates the First Amendment. While this is common sense, sense did not seem to be so common among lawmakers in the state.
According to Fox News:
The Supreme Court ruled Tuesday that Colorado cannot enforce its so-called "conversion therapy" ban regarding conversations between therapists and minors, saying the law likely violates the First Amendment by allowing some viewpoints but not others.
In an 8–1 decision, the high court said the law favors one viewpoint by allowing therapists to affirm a minor's gender identity or sexual orientation, but not help them to change it if they want to.
"The First Amendment stands as a shield against any effort to enforce orthodoxy in thought or speech in this country," Gorsuch wrote. "It reflects instead a judgment that every American possesses an inalienable right to think and speak freely, and a faith in the free marketplace of ideas as the best means for discovering truth. However well-intentioned, any law that suppresses speech based on viewpoint represents an ‘egregious’ assault on both of those commitments."
This ruling was 8-1. Can you guess who cast the lone dissenting vote?.... If you guessed Justice Ketanji Brown Jackson, you are correct.
"Before now, licensed medical professionals had to adhere to standards when treating patients: They could neither do nor say whatever they wanted," Jackson wrote. "Largely due to such State regulation, Americans have been privileged to enjoy a long and successful tradition of high-quality medical care."
What the law essentially did was mandate that Conservatives and religious folks affirm the LGBT identities of their children, regardless of whether or not that contradicts their faith. Legally, this meant the government had more say over this than parents. It is hard to see how lawmakers believed they had the power to decide these sorts of things, especially a blanket ban for children they didn't even know existed, which was all under the guise of fake compassion.
Even if you truly believe some kids are trans, which they are not, this does not give lawmakers the right to demand that every and all parents affirm these identities, as if medical and psychological care is universal for every individual.
To sum this up, the state decided the therapist could not tell girls they were girls and boys they were boys. The fact that it took the highest court of this land to label that unconstitutional is a scandal in itself. But better late than never, right?
