Elon Musk's SpaceX filed a lawsuit on Friday against the U.S. government, claiming that the Department of Justice (DOJ) case accusing the company of refusing to hire refugees and asylum seekers violates the U.S. Constitution.

The lawsuit says the administrative judges who typically hear cases concerning employee bias against immigrants are not appropriately appointed, and that keeping the case out of court denies SpaceX its constitutional right to a jury trial.

The administrative hearing officer is appointed by the Justice Department, and we are to believe that is an impartial judge who will fairly determine the merits of the complaint. What a joke.

The DOJ filed a lawsuit in Aug. against SpaceX claiming the company discriminated against asylees and refugees in hiring. The lawsuit alleges that SpaceX routinely discouraged asylum seekers and refugees from applying and refused to consider them because of their citizenship status, which they allege is in violation of the Immigration and Nationality Act (INA).

When Elon Musk was asked why the company only hires Americans, he said “I think people are a bit confused about this; unfortunately, this is not up to us,” Musk said. “U.S. Government regulations make getting a job in the U.S. hard enough as it is, but if you’re working on rocket technology, that’s considered an advanced weapons technology, so even a normal work visa isn’t sufficient unless you get a special permission from the Secretary of Defense or the Secretary of State. So I want to be clear, this is not out of some desire of SpaceX to just hire people with green cards.”

The DOJ also said that SpaceX wrongly claimed that export control laws made it so they could hire only U.S. citizens and lawful permanent residents.

“I think that this is not a wise policy for the U.S., because there are so many talented people all around the world that would love to have worked at our company, but unless they can somehow get a green card we’re legally prevented from hiring anyone,” Musk said. “I wish we could do more, but our hands are tied.”

Export control laws are meant to prevent advanced technical data from falling into the hands of adversaries and dangerous foreign governments. What if those ‘refugees’ and ‘migrants’ are from those hostile countries? How are we supposed to know what their intentions are?

I would assume it is already extremely difficult to conduct a background investigation on a ‘refugee,’ if not IMPOSSIBLE.

The justice department is really claiming that because SpaceX attempted to prevent certain technologies from getting in the hands of U.S. adversaries, it violated federal law. What a clown show.

It was the Biden administration who opened the doors for literally EVERYONE and now they want to force SpaceX to hire unvetted “refugees.” How does that make any sense? Oh wait, it doesn’t. Nothing this administration does makes sense. It's America Last and Migrants First with Sleepy Joe.
