It turns out, though, the left does not need to understand this country’s founding documents because there is this little thing called the judicial system, which protects the rights of Americans when officials blatantly infringe on them.
The Court of Appeals in D.C. just ruled that banning “firearm magazines that are able to hold ‘more than 10 rounds of ammunition’ was unconstitutional, violating the Second Amendment,” according to DC News Now.
In the case United States and the District of Columbia v. Tyree Benson, Benson claimed that he was unconstitutionally convicted for owning a gun that had a magazine that could hold over 10 rounds of ammunition.
The ruling stated that the federal government, a prosecutor in the case, had acknowledged that the ban violated the Second Amendment, but that the District’s government continued to defend the ban.
It turns out that when you ban these types of firearms, you nearly ban “half of all magazines that citizens own.”
So they can claim they are not infringing on your rights, but that is not how things played out: they nearly banned 50% of magazines in the Washington, D.C., area.
In the ruling, the Court of Appeals stated that these magazines are “ubiquitous” in the nation and account for around half of the magazines that citizens own, coming standard with many popular guns sold in the U.S.
Some argue that the Second Amendment is what protects all your other rights. So, when the left claims this will save lives, what they really mean is that it is one step towards total tyranny.
This is not the only leftist territory trying to infringe on the rights of Americans, as places like California and New York have implemented similar bans.
Last March, “The 9th U.S. Circuit Court of Appeals ruled Thursday that California’s ban on magazines capable of holding more than 10 rounds is constitutional, overturning a previous ruling by a San Diego federal judge who found the state law violated the Second Amendment.”
SCOTUS has yet to decide whether to grant a formal hearing on the California case.
