Federal Court Orders California School Cannot Force Teachers To Lie To Parents About Their Children

A California federal court has granted two teachers reprieve from a dangerous school district policy forcing them to lie to parents about their children’s gender identity. The court order also denies motions to dismiss the case filed by both the Escondido Union School District and the California Department of Education.
Elizabeth Mirabelli and Lori Ann West, the two teachers who filed the case, claimed that their First Amendment rights to free speech and the free exercise of religion were being violated.
It is refreshing to see that we still have some great teachers in this country.
The EUSD Parental Exclusion Policy forces teachers to actively deceive parents and participate in a student’s social transition. Which subsequently, violates parents’ fundamental right to raise their own children, and it violates teacher’s First Amendment rights of freedom of speech and free exercise of religion.
Judge Roger T. Benitez called EUSD's Parental Exclusion Policy a "trifecta of harm."
“The school’s policy is a trifecta of harm: it harms the child who needs parental guidance and possibly mental health intervention to determine if the incongruence is organic or whether it is the result of bullying, peer pressure, or a fleeting impulse. It harms the parents by depriving them of the long recognized Fourteenth Amendment right to care, guide, and make healthcare decisions for their children. And finally, it harms plaintiffs who are compelled to violate the parent’s rights by forcing plaintiffs to conceal information they feel is critical for the welfare of their students -- violating plaintiffs’ religious beliefs,” Benitez said.
It is nice to see that the court acknowledged that protecting children also means protecting a parents’ rights to raise them without being unjustly threatened by an intrusive and tyrannical government.
Children are not capable of making important decisions regarding these sorts of issues, which is why someone needs to have the authority to decide what’s best for them on their behalf. But communists in California deny parental authority, and believe that the state should override parents' decisions about their children’s best interests.
Childrearing authority has always belonged to parents but schools attempt to block that natural right by declaring parents as unfit or child abusers when nothing has even happened to warrant such an allegation.
School districts have also been taking away the constitutional rights of teachers for far too long.
The court ruled that the policy “harms [teachers] who are compelled to violate the parent’s rights by forcing plaintiffs to conceal information they feel is critical for the welfare of their students -- violating plaintiffs’ religious beliefs.”
Compelled speech is unconstitutional and more great teachers need to stand up for their God given rights.
The court agreed, and stated, “Mirabelli and West face an unlawful choice along the lines of: ‘lose your faith and keep your job, or keep your faith and lose your job.’”
The government cannot force anyone to support certain expressions. Thus, the government cannot punish anyone for his speech, or from refusing to adhere to the government’s approved messages.
The two things communist hate the most are family and religion. And that is why they actively seek to undermine and challenge those rights.
