Biden DOJ: Law Making Prostitutes Disclose They Have HIV Violates Americans With Disabilities Act

We previously reported how the ACLU may be more racist and transphobic than we thought. That is because they recently sued the State of Tennessee because they believe the crime of knowingly infecting someone with HIV, an incurable virus, should be condoned because this is a "protected disability." They essentially said that this purposeful act is justified because black and trans people are only doing this since they are disabled and probably don't know better. Yes, that is de facto what they implied.
Well, the DOJ decided to make a new development in this suit by announcing it on "World Aids Day."
"The DOJ said Friday, on World AIDS Day, that the State of Tennessee, its Bureau of Investigation, and the Shelby County District Attorney’s Office violated the Americans with Disabilities Act (ADA) by enforcing the state’s aggravated prostitution statute against people living with HIV.
Tennessee’s aggravated prostitution statute, passed in 1991, made it a Class C felony “when, knowing that such person is infected with HIV, the person engages in sexual activity as a business or is an inmate in a house of prostitution or loiters in a public place for the purpose of being hired to engage in sexual activity.” Aggravated prostitution is also categorized as a “violent sexual offense” that mandates registration on the Tennessee Sex Offender Registry if convicted."
In October, the ACLU and the Transgender Law Center filed a lawsuit in a Tennessee district court, arguing that the law violates equal protection, due process, and the prohibition against cruel and unusual punishment.
The DOJ’s investigation concluded that people with HIV face harsher criminal penalties solely because of their HIV status, thereby violating Title II of the ADA."
It appears that the people in charge of the investigation may have lost their minds.
Nothing in the law mentions anything about race or being transgender. But the ACLU still said it disproportionality targets them. This means that calling this law "racist" or transphobic" makes you all of that.
“Beliefs and assumptions that individuals with HIV will spread it, or that having HIV is a death sentence, are now outdated and unfounded," Rebecca Bond, Chief of the DOJ Disability Rights Section wrote in a letter, according to the outlet.
In other words, even if they knowingly spread this incurable disease, it is okay due to the fact it is outdated to claim "HIV is a death sentence."
Is there anyone able to make any sense of this?
Would it still be discrimination if they changed the law to cover all STDs? Would that make the DOJ happier?
I think we all know what they are going to say if you infect someone with the invisible sniffles, otherwise known as COVID-19.
Knowingly infecting someone with an incurable disease should be a very serious offense. I do not understand why we even have to discussing this. But only progressives would find that controversial. But I am not surprised since Democrats always try and rewrite laws to favor criminals. What else is new?
