Betsy Devos Set to Return Due Process in Campus Accusations

Courtney Kirchoff
July 26, 2017

Under Obama, "innocent until proven guilty" changed to "all beings with penises are rapists." Leftists pushed to basically eliminate due process for college men accused of rape (see Guy Expelled from Colorado State… for NOT Raping Someone and JUSTICE: Student Falsely Accused of Raping ‘Mattress Girl’ Sues for Defamation).

Department of Triggering Liberals Education Secretary Betsy DeVos is looking to change that.

And on top of that, DeVos has taken it upon herself to deconstruct perhaps the most contentious of the Department of Education’s jurisdictions: its directives for campus sexual-assault cases, which are issued pursuant to Title IX, the federal law banning sex discrimination in higher education. When DeVos invited experts on the issue to private listening sessions, the voice given to men accused of sexual assault drew outrage from sexual-assault victims.

Hence the previous administration castrating men's ability to speak for themselves. The victims get triggered when the accused men dare defend themselves. What douches.

By the numbers, this is not entirely unjustified. Statistically speaking, false sexual-assault accusations constitute a minority of all claims, maybe 10 percent at most, but likely closer to 5 percent. (As with all sexual-assault statistics, it is important to note that these estimates are imprecise.) However, as the Obama administration led the Department of Education on a social-justice march toward a total abandonment of individual justice in favor of virtue signaling, Kafkaesque trials of every possible kind sprouted across the country.

"Kafkaesque" means nightmarish. I Googled it for you. The rules got flipped: "Guilty until proven innocent" isn't much of a stretch. For leftists, what matters most is the "seriousness of the charge" not so much whether "a person is guilty of the serious charge." Get accused of something serious, and you're branded for life. Your innocence matters not. But only if you're a man. There seems to be evidence aplenty that Amy Schumer steals jokes. Alas, her career carries on. Like the energizer bunny with a dildo.

Which has been the problem up until now. It's been assumed if a man is accused of being a rapist, he's a rapist deserving castration. Public shaming. A ruined life. Except many manipulative she-devils know that's how the game is played. So if a nasty nymph wants to ruin a man's life, all she must do is accuse him of rape. See the problem?

Obama’s 2011 “Dear Colleague” letter imposed a number of measures on campus sexual-assault cases; they were far too stringent in some domains while ignoring others. Most controversially, this “guidance” document suggested (in practice, required) that universities try sexual-assault cases using the “preponderance of the evidence” standard — meaning a student is punished, possibly expelled, if it’s more likely than not he is guilty — rather than the “clear and convincing evidence” standard, a higher burden that still requires less proof than the “beyond a reasonable doubt” standard used in criminal trials. However, contrary to popular belief, this directive was not terribly consequential — studies have found that 80 percent of universities adopted the preponderance-of-the-evidence standard before the letter.

A woman was recently punished for falsely accusing men of rape. Here, get caught up: 'Victim' Who Falsely Accused Students of Rape Now Faces Prison Time. Where there's one, there's many. Isn't that what leftists echo when even one rape case comes up? It's just one of many! Two can play that game. If one woman is falsely accusing men of rape, how many more are there? Incidentally, for every false rape case lobbed by a woman scorned, guess who suffers? Besides the men whose lives are essentially ruined. Actual rape victims are hurt by false rape claims. Goes to the "crying transwolf in the ladies bathroom" thing.

Maybe the Department of Education can also debunk some of the BS statistics that the left keeps throwing around. Start with this one:
